If Plaintiff wishes to proceed with this case, he must do one or the other by 6/19/20. If Plaintiff neither pays the fee nor files an IFP application by that date, the Court will summarily dismiss this case. Until Plaintiff resolves his fee status, he should refrain from filing any further amendments or routine motions. Once Plaintiff's fee status is resolved, the Court will screen his complaint (the initial complaint and most recent amended complaint) to determine whether this case may proceed. See 28 U.S.C. 1915A. | Filing 35 MINUTE entry before the Honorable Iain D. Johnston: The plaintiff's motions to appoint a special process server #27 and #28 are denied without prejudice. In the motion the plaintiff asks the Court to order defendant Kerry O'Brien to act as a special process server and for O'Brien and defendant Faheen Fathima to coordinate service of Fathima by O'Brien. To begin, the motion appears to be premature. The plaintiff contends that he sent Fathima a request to waive service, and under Federal Rule of Civil Procedure 4(d)(1)(F) a recipient has at least 30 days to execute the waiver. Those 30 days cannot have yet run because the plaintiff filed his complaint less than 30 days ago on 4/16/2020. Moreover, the plaintiff has identified no authority under which this Court can compel O'Brien to act as a special process server. The plaintiff's request to order O'Brien and Fathima to provide him with the identities and contact information for the Doe defendants is also denied without prejudice. The plaintiff contends that the post office did not deliver his subpoena to O'Brien and Fathima for that information. But given the plaintiff's assertion that all defendants but Fathima and the Doe defendants waived service, he can instead serve O'Brien with discovery requests for the information after she appears and the Court enters a discovery scheduling order.
