August 11, 2020 Opinion or Order Filing 12 ORDER: The Court grants Plaintiff's application to proceed in forma pauperis #11 and authorizes the trust fund officer at Plaintiff's place of incarceration to deduct $1.14 from Plaintiff's account as the initial partial payment of the filing fee and to continue making deductions in accordance with this order as set forth below. The Court directs the Clerk to: (1) send a copy of this order of the facility having custody of Plaintiff and to the Court's Fiscal Department; (2) file Plaintiff's amended complaint #11 ; (3) dismiss Defendant Nicklaus; (4) issue summons for service of the amended complaint on Defendant Williams (along with the USM-285 form returned by Plaintiff [Dkt. 10, Attachment #2, pg. 1]; (5) alter the case caption to Elam v. C. Williams; and (6) send Plaintiff filing instructions and a copy of this order. The Court appoints the U.S. Marshal to serve Defendant Williams, using the USM 285 form submitted by Plaintiff [Dkt. 10, Attachment #2, pg. 1]. The Marshal is appointed to effect service and is authorized to send a request for waiver of service in the manner prescribed by Fed. R. Civ. P. 4(d) before attempting personal service.
