August 26, 2020 Opinion or Order Filing 23 ORDER: Petitioner has until 9/16/2020 to reply to USP Thomson Case Manager Derick Boyer's declaration #13 concerning the signature bearing Boyd's name in the certificate section of Petitioner's initial in forma pauperis (IFP) application #3 . If Petitioner files a reply and seeks to establish the signature's authenticity, he should include information about how he obtained the signature. If Petitioner does not reply to the declaration, the court will address his IFP application without the benefit of a reply. No action will be taken on this case until the issue concerning the IFP application is resolved. Petitioner is advised that a finding by this court that he engaged in fraud to obtain IFP status can result in sanctions including, but not limited to, dismissal with prejudice. See Ayoubi v. Dart, 640 F. App'x 524, 528-29 (7th Cir. 2016) ("dismissal with prejudice is an appropriate sanction for lying to the court in order to receive a benefit from it, because no one needs to be warned not to lie to the judiciary"). August 26, 2020 Opinion or Order Filing 22 ORDER: Petitioner's motions seeking attorney representation #9 #19 are denied without prejudice. The court will not consider requests for representation until after it conducts its initial review of the petition pursuant to Rule 4 of the Rules Governing 2254 Cases, which the court cannot do until the filing fee issue is resolved. Petitioner's motion seeking to proceed in forma pauperis (IFP) or reconsider his previously filed IFP application #14 is denied as it presents neither an IFP application nor any grounds supporting reconsideration. July 28, 2020 Filing 8 MINUTE entry before the Honorable Gary Feinerman:Petitioner submitted an application to proceed in forma pauperis (IFP) #3 . The application's certificate section from an authorized officerwhere a prison officer attests to the amount of funds in the applicant's prison trust accountcontains the purported signature "Boyer." The signature includes no first name, initials, or rank of the officer, and the handwriting of the signature appears very similar to Petitioner's handwriting on other parts of the application. The court therefore questions the authenticity of the signature. Accordingly, the court requests that the Warden at USP Thomson verify whether Officer "Boyer" signed the certificate. The Warden is requested to respond to this order by 8/11/2020. The court authorizes the Warden, through counsel, to enter an appearance for the limited purpose of addressing the authenticity of the officer's signature on the IFP application. The Clerk is directed to send a copy of this order, along with a copy of the IFP application #3 , to the Warden at USP Thomson, and to the United States Attorney's Office in Rockford, Illinois. The court defers further action on this case pending resolution of the issues raised in this order. Petitioner's motion for an emergency preliminary injunction for greater access to his legal materials to file additional pleadings #7 is denied. The fact that Petitioner continues to make filings in this and other cases undermines any contention that he is being denied access to the courts.
