Filing 10 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is denied for lack of a sufficient showing of indigence. By September 30, 2020, Plaintiff must: (1) pay the full filing fee of $400.00; and (2) explain in writing her apparent failure to include a settlement payment among her financial disclosures. If she fails to comply with both of these directives, the Court will summarily dismiss this case. Plaintiff may file her response under seal if she believes this is necessary to comply with the terms of any settlement agreement she has entered (to do so, she should write "File Under Seal With Permission of the Court" on the top of her submission). Signed by the Honorable Matthew F. Kennelly on 9/8/2020. Mailed notice. (bg, ) |
Filing 9 EXECUTIVE COMMITTEE ORDER: It appearing that 20 CV 50258, Mardis v. Rosenie, and 20 CV 50259, Mardis v. McCalister are currently assigned to the Hon. Harry D. Leinenweber; therefore It is hereby ordered that 20 CV 50258, Mardis v. Rosenie, and 20 CV 50259, Mardis v. McCalister be reassigned to another active district judge listed in the Amended General Order 19-0007 pursuant to 28 USC 294(b). Case reassigned to the Honorable Matthew F. Filing 8 MINUTE entry before the Honorable Harry D. Leinenweber: The Court's previous Order #7 is vacated because it was entered in error. Plaintiff Mardis's Application for Leave to Proceed in forma pauperis #3 is reinstated. This Court does not handle cases of this nature, and the case will be reassigned to another judge in this District. Mailed notice(maf) |
Filing 7 ORDER: Plaintiff Jaleel Mardis's Application for leave to Proceed in forma pauperis #3 is denied without prejudice to re-file. Mardis is required by statute to submit "a certified copy of the trust fund account statement... for the prisoner for the 6-month period immediately preceding the filing of the complaint." See 28 U.S.C. 1915(a)(2). Mardis has submitted a statement covering the period between November 2019 and April 2020, but she signed her Complaint July 7, 2020. If Mardis wishes to re-file, she should include her trust fund account statement covering the period at least through the end of June. It would be helpful to the Court if that statement included the amount of the average monthly deposits into Mardis's account and the average monthly balance in her account for the six-month period from January 2020 to the end of June or early July 2020. Signed by the Honorable Harry D. Leinenweber on 8/20/2020:mailed notice(pg, ) |
