ORDER: Petitioner Frederick Henry Suttles, a federal prisoner incarcerated at USP Thomson, brings this 28 U.S.C. 2254 petition challenging his 1993 conviction in Springfield, Massachusetts. Although venue for a 2254 petition exists in either the federal judicial district where a petitioner is in custody or where he was sentenced, see 28 U.S.C 2241(d), where he was convicted and "where... records and witnesses pertinent to petitioner's claim are likely to be found," is generally considered the more appropriate forum. Braden v. 30th Judicial Circuit Court of Kentucky, 410 U.S. 484, 493-94 (1973). In this case, where the petitioner seeks to challenge an older Massachusetts conviction, the sentence for which may or may not still exist, the federal district court in that state appears to be a more appropriate forum. Accordingly, the Clerk of Court is directed to transfer this case to the United States District Court for Massachusetts, Springfield Division. See 2241(d); see also 28 U.S.C. 1404(a).
