Johnston has been appointed as a United States District Judge for the Northern District of Illinois, Western Division; therefore IT IS HEREBY ORDERED That the attached list of civil cases are hereby reassigned to form the initial calendar of the Honorable Iain D. Johnston; and It is further ordered that the Fourth Amended General Order 19-0007 -Western Division Reassignment Wheel, be vacated in its entirety and this General Order supersedes it; and It is further ordered the Clerk of Court is to add Judge Johnston's name to the Court's existing civil and criminal case assignment system so that he shall receive a full share of such cases; and It is further ordered that all criminal cases that were assigned and reassigned pursuant to General Order 19-0007 shall remain assigned to the current district judge absent further order of the Court. September 8, 2020 Opinion or Order Filing 5 ORDER: Petitioner Lamarlvin Watts filed a 28 U.S.C. 2241 petition in this court without paying the $5.00 filing fee or submitting an in forma pauperis (IFP) application demonstrating he cannot pay. To proceed with this case, by October 8, 2020, Petitioner must either pay the filing fee by check or money order made payable to Clerk, United States District Court, Northern District of Illinois, or submit a completed IFP application. His failure to comply will result in summary dismissal of this case. Additionally, though the court should not look at the substance of Petitioner's 2241 petition until the filing fee is resolved, his petition challenges his Southern District of Georgia conviction and sentence. Petitioner's 2255 motion challenging the same conviction is still pending in the Georgia court. See Watts v. United States, No. 4:19-cv-78-WTM-CLR (S.D. Ga.). A 2241 challenge to a federal conviction or sentence is allowed only if "the remedy by [a 2255] motion is inadequate or ineffective to test the legality of detention." 2255(e); see also In re Davenport, 147 F.3d 605, 610 (7th Cir. 1998).
