Reinhard on 7/19/2021: By order dated June 2, 2021, the court dismissed plaintiff's complaint because it failed to state a claim on which relief could be granted but allowed plaintiff leave to amend her pleading if she believed she could state a valid federal claim #7 . At that time, the court warned plaintiff that failure to submit an amended complaint by July 7, 2021, would result in dismissal of this case for failure to state a claim. Plaintiff has not submitted an amended complaint to date. Accordingly, this case is dismissed with prejudice for failure to state a claim. See Dkt. #7 , June 2, 2021 Order (discussing deficiencies in plaintiff's complaint). If plaintiff wants to appeal this dismissal, she may file a notice of appeal in this court within thirty days of the entry of judgment. Fed. R. App. P. 4(a)(1)(A). Filing 7 ORDER : Plaintiff's motion for leave to proceed in forma pauperis #3 is granted. The filing fee is waived. However, summons shall not issue. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim. By July 7, 2021, plaintiff must submit an amended complaint and a completed USM-285 (Marshals service) form for each defendant named in the amended complaint. If she fails to comply, the court will dismiss the case for failure to state a claim. The Clerk is directed to send plaintiff an amended civil rights complaint form and instructions, a blank USM-285 form, and a copy of this order. Filing 5 MINUTE entry before the Honorable Lisa A. Jensen: On 9/15/2020, this Court held a status hearing with Plaintiff Victoria C. McKenzie in Case No. 20-cv-50249. In that case, the Court granted Plaintiff's request for counsel and ordered recruited counsel to file a status report by 10/30/2020 on whether he plans to proceed with an amended complaint or a statement that he cannot amend the complaint consistent with his obligations under Federal Rule of Civil Procedure 11. On 9/16/2020, Plaintiff filed the following new cases, Case Nos. 20-cv-50351, 20-cv-50352, 20-cv-50353, and 20-cv-50354, and requested attorney representation.
