Reinhard: Plaintiff, Metropolitan Casualty Insurance Co. brought this action against defendant Fleming Heating & Air Conditioning, Inc., in Illinois state court. Defendant removed #2 the action to this court premised on diversity of citizenship jurisdiction. 28 U.S.C. 1332(a)(1). Defendant alleges plaintiff is a Rhode Island citizen (incorporated there and principal place of business there) and that defendant is an Illinois citizen. "A civil action otherwise removeable solely on the basis of [diversity of citizenship] may not be removed if any of the parties in interest properly joined and served as a defendant is a citizen of the State in which such action is brought." 28 U.S.C. 1441(b)(2). Plaintiff's complaint alleges, and the records of the Illinois Secretary of State appear to confirm, that defendant is an Illinois corporation and, thus, a citizen of Illinois for diversity of citizenship purposes. 28 U.S.C. 1332(c)(1).
