ORDER with Statement; Plaintiff's application for leave to proceed in forma pauperis [R. 3] is granted. The Court authorizes and orders the trust fund officer at Plaintiff's place of incarceration to deduct $58.75 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. Plaintiff's trust fund officer must collect 100% of all income into his trust account until accrued filing fees are paid. However, summonses shall not issue at this time. The Court stays this matter pending a determination in Van Sach v. Dep't of Justice, No. 20 CV 50180 (N.D. Ill) as to whether Bivens provides a remedy for Plaintiff's claims. Even though the case is stayed, Plaintiff must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the Court informed of his address may lead to dismissal of this action for failure to comply with a Court order and for want of prosecution. See attachment for full detail.
