Filing 13 PLRA Fee Notice and Order dated 2/11/2021 from the Seventh Circuit regarding notice of appeal #7 ; Appellate case no. : 21-1171. (jp, ) |
Filing 12 ORDER with Statement; Plaintiff's application to appeal in forma pauperis #11 is denied because Plaintiff has struck out under 28 U.S.C. 1915(g), and the events underlying his claims do not pose an imminent danger of serious physical harm. Furthermore, the Court certifies that the appeal is not taken in good faith. Plaintiff is ordered to pay the $505 appellate filing fee within fourteen days, or the Court of Appeals may dismiss his appeal for want of prosecution. The Clerk of Court is directed to send a copy of this order to the PLRA Attorney, United States Court of Appeals for the Seventh Circuit. See the attached order for full details. Signed by the Honorable Iain D. Johnston on 2/11/2021: Mailed notice (yxp, ) |

***Civil Case Terminated. (jp, ) |
Filing 6 ORDER; This case is administratively closed as duplicative of Jordan v. Federal Bureau of Prisons, No. 3:20-cv-50456 (N.D. Ill.) (Johnston, J.). Because the Court is administratively closing this case, a filing fee will not be assessed under 28 U.S.C. 1915(b) nor will a "strike" be assessed under 28 U.S.C. 1915(g). Now that Plaintiff has been warned that duplicative lawsuits are impermissible, however, he will be required to pay the filing fee for future duplicative lawsuits and those suits may be dismissed as frivolous or malicious under 28 U.S.C. 1915(g). See Smith v. Gleason, No. 12-cv-633-WMC, 2013 WL 6238488, at *7 (W.D. Wis. Nov. 27, 2013) ("Repetitive allegations are considered malicious and are grounds for dismissal under the PLRA.") (citing Lindell v. McCallum, 352 F.3d 1107, 1109-10 (7th Cir. 2003)). All pending motions are denied as moot. See attachment for full detail. Signed by the Honorable Iain D. Johnston on 1/12/2021: Mailed notice (yxp, ) |
