Filing 6 MINUTE entry before the Honorable Iain D. Johnston: Having reviewed case number 3:20-cv-50475, it is hereby consolidated into case number 3:21-cv-50097 pursuant to Fed. R. Civ. P. 42(a)(2). Case number 3:21-cv-50097 is a removal from a state court action that was previously removed to this court and remanded. Plaintiff amended the complaint in state court and the federal defendant once again removed the case to this court. Before amending the state complaint to reinstate the federal defendant, Plaintiff filed 3:20-cv-50475 as a separate action in federal court that named only the federal defendant. Thus, the Court now has two cases with identical questions of law and fact. Because case number 3:21-cv-50097, the removal from state court, contains all defendants, case number 3:20-cv-50475 is consolidated into that case. (yxp, ) |
