January 20, 2023 Opinion or Order Filing 25 Letter/Citations by Kareem A. Doctor (Attachments: #1 Envelope postmarked 1/17/23)(pg, )
December 14, 2022 Opinion or Order Filing 24 ORDER Petitioner has submitted a letter #23 to this Court that, without context, contains citations to various Supreme Court cases. None of the cases relate to Petitioner's 28 U.S.C. 2241 petition, which this Court denied on October 18, 2022 #19 , and the letter contains no explanation as to their significance nor asserts what relief, if any, Petitioner may be seeking. Attached to the letter is a copy of the Court's judgment #20 that was entered upon the denial of his 2241 petition. The judgment contains various annotations that appear to have been made by Petitioner. To the extent Petitioner's letter can be construed as a Rule 60(b) motion for relief from judgment, his motion is denied. A Rule 60(b) motion may be granted only for: (1) mistake, inadvertence, surprise, or excusable neglect; (2) newly discovered evidence; (3) fraud or misconduct by the opposing party; (4) the judgment is void; (5) the judgment has been satisfied, released, or discharged; and (6) any other reason that justifies relief. See Fed. R. Civ. P. 60(b). "Relief under Rule 60(b)(6) requires a showing of extraordinary circumstances justifying the reopening of a final judgment." Arrieta v. Battaglia, 461 F.3d 861, 865 (7th Cir. 2006). Petitioner's letter provides no basis for granting relief under Rule 60(b). This case remains closed. Signed by the Honorable Iain D. Johnston on 12/14/2022: Mailed notice (yxp, )
December 9, 2022 Opinion or Order Filing 23 LETTER from Kareem A. Doctor dated 12/5/2022. (Attachments: #1 Envelope)(jp, )
November 28, 2022 Opinion or Order Filing 22 ORDER; On October 18, 2022, the Clerk's Office mailed to Petitioner a copy of the opinion #19 and judgment #20 that were entered in his case. The documents were mailed to USP Thomson, Petitioner's address of record on the docket. The U.S. Postal Service returned these documents as undeliverable #21 . The Clerk's Office is not required to track down litigants. It is the responsibility of Petitioner to maintain a current address with the Court. Nevertheless, the Bureau of Prisons' records indicate that Petitioner has been transferred to USP Coleman II. The Clerk will resend the documents to Petitioner at his current address, but Petitioner is instructed that he must advise the Court of any subsequent address changes by promptly filing a Notice of Change of Address form. Petitioner is further reminded to consult pages 16 and 17 of the Court's opinion #19 for his appellate rights. See also Fed. R. App. P. 4(a)(1)(B). The Clerk is instructed to: (1) update Petitioner's address to USP Coleman II, U.S. Penitentiary, P.O. Box 1034, Coleman, Florida 33521; and (2) resend to Petitioner copies of the October 18, 2022 opinion #19 and judgment #20 . Signed by the Honorable Iain D.
