Filing 7 ORDER; Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court authorizes and orders the trust fund officer at Plaintiff's place of incarceration to deduct $4.03 from Plaintiff's account for payment to the Clerk as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk is directed to send a copy of this order (electronically if possible) to the trust fund officer at the Lawrence Correctional Center and the Court's fiscal department. Following initial review, Plaintiff's complaint #1 is dismissed with prejudice, except that to the extent that Plaintiff is challenging the basis for his incarceration, the dismissal is without prejudice to his ability to initiate another civil rights lawsuit under 42 U.S.C. 1983 if and when his conviction is invalidated. The dismissal of this case counts as one of Plaintiff's three allotted dismissals under 28 U.S.C. 1915(g). Plaintiff's motion for attorney representation #4 is denied as moot; the Court adds that counsel would not have helped Plaintiff as with or without representation, the result would be the same.
