| Filing 5 MINUTE entry before the Honorable Philip G. Reinhard: Plaintiff brings this action pro se using the fill-in form "Complaint for Violation of Constitutional Rights" available from the district court. Plaintiff seeks to proceed in forma pauperis #3 so the court reviews the complaint #1 pursuant to 28 U.S.C. 1915(e)(2). The caption indicates the case is against defendants Hampton Meadows Apartment LLC and Winter Associates, Inc. d/b/a Winter Property Management. In the body of the complaint, the defendant is identified as J. Douglas Winter, President. The complaint asserts it is a claim for a violation of plaintiff's civil rights brought under 42 U.S.C. 1983. However, there are no factual allegations as to how the defendants, which are private entities and a corporate officer, were acting under color of state law to deprive plaintiff of her civil rights. The factual allegations are sparse making it impossible to determine what defendants did to deprive plaintiff of her civil rights. Thus, the complaint fails to state a claim on which relief may be granted and must be dismissed. 28 U.S.C. 1915(e)(2)(B)(ii). The complaint #1 is dismissed without prejudice. On or before September 24, 2021, plaintiff shall file an amended complaint properly stating a claim, or this case will be dismissed with prejudice.
