October 25, 2021 Opinion or Order Filing 5 ORDER; Federal prisoner Lashaun Casey has sent a letter #4 complaining that Thomson staff are not treating the Court's orders like legal mail, that it took a week for him to receive the Court's October 13, 2021 order #3 , and that he did not receive a complaint form. Communications from this Court that are placed on the public docket are just thatpublic documents. See Guajardo-Palma v. Martinson, 622 F.3d 801, 804 (7th Cir. 2010) (communications from courts to prisoners on the public docket "are public document which the prison officials have as much right to read as the prisoner") (internal citation omitted). The Court takes mail delays into account when setting due dates as mail delivery is necessarily not instantaneous. The Clerk is directed to send Plaintiff another complaint form along with instructions. The November 15, 2021 due date for Plaintiff to address his filing fee obligations and submit a complaint on the Court's form that contains all of the specified information stands, as he has already received the in forma pauperis application form and the facts underlying this lawsuit are straightforward, within his personal knowledge, and already summarized in his procedurally improper "affidavit of facts" #1 . October 13, 2021 Opinion or Order Filing 3 ORDER; Federal prisoner Lashaun Casey sent the Clerk a document entitled "Declaration of Lashaun Casey" #1 . He has neither prepaid the filing fee nor sought leave to proceed in forma pauperis (in other words, requested permission to pay the filing fee in installments over time). In addition, he has not submitted a complaint on the Court's mandatory form. See L.R. 81.1. By November 15, 2021, Plaintiff must: (1) pay the full $402 filing fee or submit a properly supported application for leave to proceed in forma pauperis that discloses all income received in the past twelve months (including gifts from family and friends and government stimulus payments); and (2) submit a complaint on the Court's form. If he fails to comply with both directives, this case will be summarily dismissed. But even if he complies, there is no guarantee that this case will proceed as his complaint will still be subject to screening and potential dismissal. In this regard, Plaintiff should bear in mind that if this case does not survive initial review (an issue not presently before the Court), his fee obligations will remain in place, 28 U.S.C. 1915(b)(1), and will follow him even if he is transferred to another facility. The Clerk is directed to send Plaintiff a copy of this order, an application for leave to proceed in forma pauperis, a form complaint for incarcerated persons, and instructions.
