At that time, the court warned plaintiff that failure to comply by 11/24/2021, would result in summary dismissal of this case. Plaintiff has neither submitted a renewed application for leave to proceed in forma pauperis nor paid the court's filing fee to date. Accordingly, this case is dismissed without prejudice for plaintiff's failure to comply with the court's order. The court directs the Clerk of Court to terminate all pending motions as moot. Reinhard on 10/20/2021: Plaintiff's application for leave to proceed in forma pauperis #3 is denied without prejudice. If plaintiff wants to proceed with this lawsuit, he must either (1) submit a renewed application that is certified by an appropriate official and accompanied by a copy of plaintiff's trust fund statement showing all transactions in his account for the six-month period immediately preceding his initiation of this action; or (2) pay the full statutory filing fee of $402.00. Failure to comply with this order by November 24, 2021, will result in summary dismissal of this case. Plaintiff also must promptly submit a change-of-address notification if he is transferred to another facility or released. Failure to keep the court informed of his address may lead to dismissal of this action for failure to comply with a court order and for want of prosecution. The Clerk of Court is directed to send plaintiff a blank application to proceed in forma pauperis and a copy of this order. October 18, 2021 Opinion or Order TEXT ORDER entered by Judge Sue E. Myerscough on 10/18/2021. Venue for federal civil rights actions is governed by 28 U.S.C. 1391(b). According to that statute, such actions may be brought only in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant may be found, if there is no district in which the action may otherwise be brought. It appears that a substantial part of the events or omissions giving rise to the claims in this lawsuit occurred in the U.S. Penitentiary in Thomson, Illinois, which is situated in the federal judicial district for the Northern District of Illinois. 28 U.S.C. 93. The court therefore finds that venue over this proceeding is in the Northern District of Illinois, and that it is in the interests of justice that this cause be transferred there. See 28 U.S.C. 1404(a). No summons shall issue in this action unless directed by the transferee court. September 28, 2021 Opinion or Order TEXT ORDER Entered by Judge Sue E. Myerscough on 9/28/2021. The clerk has received a letter from Plaintiff stating that Plaintiff intends to file a lawsuit about food poisoning he suffered during his incarceration in the U.S. penitentiary in Thomson, Illinois. This case has been opened, but whether Plaintiff intends to bring an action now is not clear because Plaintiff's letter requests forms. The clerk is directed to send Plaintiff the prisoner civil rights complaint form, petition to proceed in forma pauperis, and instructions for both. Plaintiff's complaint and petition to proceed in forma pauperis are due October 26, 2021, or this case will be dismissed without prejudice. Plaintiff is advised that the proper venue for his lawsuit is in the Northern District of Illinois since that is where the incidents occurred. If Plaintiff files the complaint and petition to proceed in forma pauperis in this case, the Court will transfer this case to the Northern District of Illinois.
