Filing 5 ORDER signed by the Honorable Philip G. Reinhard on 12/8/2021: Petitioner's in forma pauperis (IFP ) application #4 is denied. His application states that he currently has $40.00 in his prison trust account and that he has received an average monthly deposit of $360 during the six-month period before he filed his 28 U.S.C. 2241 petition. Such funds do not qualify him for IFP status for the filing fee. See Lucien v. DeTella, 141 F.3d 773, 774 (7th Cir. 1998). He can pay the $5.00 fee, and must do so to proceed with this case. By January 12, 2022, petitioner must send a check or money order made payable to the Clerk, United States District Court, Northern District of Illinois. His failure to comply will result in dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f). Electronic notice/mailed copy to petitioner. (sb, ) |
Filing 4 APPLICATION by Petitioner Rodney X. McIntosh for leave to proceed in forma pauperis (Attachments: #1 Envelope) (jp, ) |
Filing 3 ORDER signed by the Honorable Philip G. Reinhard on 11/4/2021: Petitioner Rodney McIntosh, a federal prisoner at USP Thomson, has filed a 28 U.S.C. 2241 petition in this court challenging several prison disciplinary penalties (either from Thomson or his prior places of incarceration). The petition cannot proceed. Petitioner neither paid the $5.00 filing fee, nor submitted an in forma pauperis application demonstrating his inability to pay. To proceed with this case, petitioner must satisfy the $5.00 filing fee either by sending a check or money order for $5.00 made payable to Clerk, United States District Court, Northern District of Illinois, or by submitting a completed IFP application. Petitioner's failure to comply by December 10, 2021 will result in summary dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f). The Clerk of Court shall send an IFP application to petitioner. Electronic notice/mailed copy of order and IFP application to petitioner. (sb, ) |
