ORDER; Petitioner's recent pleading, which seeks both: (1) to appeal this Court's November 4, 2021 dismissal order, and (2) the recruitment of an attorney, has been docketed in this Court as a notice of appeal and as a motion for appellate counsel. The motion for counsel #7 is denied without prejudice to Petitioner submitting his request to the Seventh Circuit with the above stated appellate case number. This Court further notes that Petitioner's current pleading indicates he wants to bring both a petition for habeas corpus relief (which challenges a criminal conviction, a sentence, or the revocation of good time credit), and a civil rights action under Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971) (which challenges conditions of confinement, including placement in solitary confinement). Petitioner initiated this case as a 2241 petition, which this Court, as explained in its prior order, should not convert into a civil rights action. See Glaus v. Anderson, 408 F.3d 382, 388-89 (7th Cir. 2005); Bunn v. Conley, 309 F.3d 1002, 1007 (7th Cir. 2002). This case thus remains a dismissed 2241 petition, which Petitioner is now appealing. ORDER with Statement; Petitioner's 28 U.S.C. 2241 petition is dismissed for the reasons below. The dismissal is without prejudice to Petitioner bringing his claims in a different type of action, but habeas corpus relief is unavailable for his claims. The current case is closed. If he seeks to appeal this order, he must file a notice of appeal in this court within 60 days of the date this order is entered. Petitioner remains responsible for the $5.00 filing fee for having filed his petition, but at this time, the Court will neither seek to collect it nor require Petitioner to demonstrate his inability to pay it through an in forma pauperis application.
