Filing 9 ENTERED JUDGMENT on 12/22/2021. Mailed notice (jp, ) |
Filing 8 ORDER : The Court dismisses any claims purporting to be brought "on behalf of Meghan M. Bodden" without prejudice as non-lawyers cannot represent other individuals. It also grants Plaintiff's application for leave to proceed in forma pauperis #3 , waives the initial partial filing fee, and orders the trust fund officer at Plaintiff's place of incarceration to make monthly deductions in accordance with this order. The Clerk is directed to send a copy of this order (electronically if possible) to the trust fund officer at Plaintiff's place of incarceration and the Court's fiscal department. Following initial review, the Court dismisses Plaintiff's complaint #1 without prejudice to his ability to seek habeas relief or initiate another civil rights lawsuit under 42 U.S.C. 1983 if and when his conviction and sentence are invalidated. Because Plaintiff's claims are currently legally frivolous, the dismissal of this case counts as one of his three allotted dismissals under 28 U.S.C. 1915(g). Plaintiff's motion concerning service of process #6 is denied as moot. The Clerk is directed to enter a final judgment of dismissal. This case is closed. [See STATEMENT] Signed by the Honorable Iain D. Johnston on 12/22/2021. Mailed notice (jp, ) |
