Filing 5 ORDER : Petitioner has paid the filing fee pursuant to this Court's prior order. His motion to stay this case while his post-conviction proceedings are pending in state court #3 is granted. This case is stayed. See Pace v. DiGuglielmo, 544 U.S. 408, 416 (2005); Tucker v. Kingston, 538 F.3d 732, 735 (7th Cir. 2008). Petitioner is directed to inform this court in writing every 90 days regarding the status of his state post-conviction case. His first status report in this court is due April 15, 2022. When his post-conviction case is no longer pending in state court, Petitioner shall have 90 days to seek to lift the stay in this case, at which time this court will conduct its initial review of his federal habeas corpus petition and determine if Respondent must respond to it. Filing 4 ORDER; Petitioner James Anderson, an Illinois prisoner, has filed: (1) a 28 U.S.C. 2254 petition challenging his Winnebago County murder conviction, and (2) a motion to stay this case until after his petition for leave to appeal (PLA) is no longer pending in the Illinois Supreme Court. Petitioner, however, has neither paid the $5.00 filing fee nor submitted an in forma pauperis (IFP) application demonstrating his inability to pay. By February 4, 2022, Petitioner must either pay the filing fee with a check or money order made payable to: Clerk, United States District Court, Northern District of Illinois, or submit an IFP application with his prison trust account statement showing activity in that account for the six-month period before he filed his 2254 petition. Petitioner's failure to comply with this order will result in dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f).
