February 25, 2022 Opinion or Order Filing 3 ORDER signed by the Honorable Philip G. Reinhard on 2/25/2022: Federal prisoner Michael DeWayne Morton, currently confined at USP Thomson, has filed a 28 U.S.C. 2241 petition in this court seeking relief under the First Step Act with respect to his sentence for his 2015 felon-in-possession-of-a-firearm conviction from the Southern District of Alabama. Morton, however, has neither paid the $5.00 filing fee, nor submitted an in forma pauperis (IFP) application showing his inability to pay. Also, Morton appears to be seeking the same relief in both this case and in his motion for relief under the First Step Act filed in his criminal case in Alabama. See United States v. Morton, No. 1:14-cr-00260, Dkt. Entry 62 (N.D. Ala.). Accordingly, by April 1, 2022, Morton must both: (1) resolve the filing fee issue either by paying the $5.00 filing fee with a check or money order made payable to the Clerk of Court, or by submitting a completed IFP application; and (2) show cause why this case should not be dismissed as duplicative of his currently pending motion in his criminal case.
