Filing 11 ORDER: The court grants plaintiff leave to proceed in forma pauperis #10 and service at government expense #4 . Plaintiff may proceed on his complaint #1 consistent with this order. The court authorizes and orders the trust fund officer at plaintiff's place of incarceration to deduct $13.24 from plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. Plaintiff's trust fund officer must collect 20% of all income into his trust account until accrued filing fees are paid. The court directs the Clerk of Court to: (1) file plaintiff's complaint #1 ; (2) to issue summonses for service of the complaint on Warden Williams, Manzano, Burke, Gee, and Baker; (3) terminate as defendants Marriza, Stevens, Miller, Coffee, Blaze, John Doe, and Jane Doe; (4) mail plaintiff five blank USM-285 service forms, filing instructions, and a copy of this order; and (5) send a copy of this order (electronically if possible) to the trust fund officer of the facility having custody of plaintiff and to this court's Fiscal Department. The court appoints the U.S. Marshal to serve defendants. The court advises plaintiff that a completed USM-285 form is required for service on each defendant. Plaintiff must fill out and return the required service form or this case may be dismissed for failure to prosecute. The U.S. Marshal will not attempt service on a defendant unless and until the required form for that defendant is received. Plaintiff must promptly update his address if it changes while this case is pending. If he fails to do so, this case will be subject to dismissal with no further warning. Filing 9 ORDER: Plaintiff's application for leave to proceed in forma pauperis #8 is denied without prejudice as incomplete. Plaintiff is required to complete and sign the "Financial Affidavit" portion of the court's application formit is unclear if plaintiff is requesting prison staff to complete that portion for him. Plaintiff must then provide his completed and signed application to an appropriate trust fund officer who will complete and sign the trust certification at the bottom of page two of the two-page application form. Plaintiff must also attach to his application a copy of his trust fund account statement covering the immediately-preceding six months (November 1, 2021 April 30, 2022). Since plaintiff was incarcerated at more than one facility during that time, he must obtain a certified trust fund account statement from Dixon Correctional Center in addition to the certified trust fund account statement from Centralia Correctional Center. If, during that time, plaintiff was incarcerated at another facility, he must obtain a certified trust fund account statement from that facility as well. Plaintiff's motion for attorney representation #3 , which reflects that he has not contacted any legal organization, is denied without prejudice as he must make a reasonable effort to obtain counsel before the court will consider a request to recruit counsel for him and in any event, nothing suggests he is unable to address his filing fee obligations. By June 7, 2022, plaintiff must either: (1) submit a completed application for leave to proceed in forma pauperis that includes the documentation and certification described in this order; or (2) pay the full statutory filing fee of $402.00. If he does not comply, the court will summarily dismiss this case.
