Filing 4 ORDER : By order dated May 9, 2022, the court directed plaintiff to either file an application to proceed in forma pauperis or pay the full $402 filing fee #3 . The court gave plaintiff until June 14, 2022, to comply. Plaintiff did not respond to the court's order, nor has he communicated with the court since he initiated this lawsuit. Filing 3 ORDER signed by the Honorable Philip G. Reinhard on 5/9/2022: Whiteside County detainee Jeramie Michael House initiated this lawsuit under 42 U.S.C. 1983, but he did not pay the court's filing fee or apply for leave to proceed in forma pauperis. Plaintiff has until June 14, 2022, to either (1) submit an application to proceed in forma pauperis on the enclosed form along with a copy of his trust fund account statement showing all transactions to his account for the six-month period immediately preceding his initiation of this lawsuit (from November 5, 2021, to May 5, 2022); or (2) pre-pay the $402.00 filing fee. Plaintiff should be aware that he must pay the filing fee even if the case is summarily dismissed. See 28 U.S.C. 1915(b)(1). Thus, he must either pay the full filing fee upfront or pay the filing fee over time in installments consisting of 20% of his monthly income (including money sent by family and friends) until the filing fee is paid in full. If he is allowed to pay in installments, the collections from his account will follow him even if he is transferred to another facility. Waiver of the fee is not an option. The court defers consideration of plaintiff's complaint under 28 U.S.C. 1915A until after his fee status is resolved.
