Filing 13 ORDER: Plaintiff's incomplete application for leave to proceed in forma pauperis #12 is denied as moot. Plaintiff's completed application #10 is granted. The court orders the trust fund officer at plaintiff's place of incarceration to immediately deduct $35.24 from plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The court directs the Clerk of Court to send a copy of this order to the trust fund officer of the facility having custody of plaintiff and to the court's Fiscal Department. Summons, however, shall not issue at this time. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a federal claim. If plaintiff wants to proceed with this lawsuit, he must submit an amended complaint that states a federal claim in light of the principles set forth in this order. Failure to submit an amended complaint by August 30, 2022, will result in dismissal of this lawsuit. Plaintiff also is advised that he must promptly submit a changeof-address notification if he is transferred to another facility or released. Failure to do so may lead to dismissal of this action for failure to comply with a court order and for want of prosecution.
