Filing 4 MINUTE entry before the Honorable Iain D. Johnston: Plaintiff Gary Conway brings this action pro se against Defendant Colonial Penn Life Insurance Co. In his complaint, he alleges that an insurance policy was taken out on his life without his consent. Before the Court is Conway's motion to proceed in forma pauperis. Because his application contains a sufficient showing of indigency, the Court grants his motion #3 . Because Conway proceeds in forma pauperis, the Court is required to screen for, among other things, failures to state a claim. 28 U.S.C. 1915(e)(2)(B). But because the Court is required to liberally construe pro se complaints, and because unconsented to stranger-originated life insurance policies are generally void unless the insured person gives consent, the Court simply notes that Conway's complaint has passed this Court's screening. See Ohio Nat'l Life Assur. Corp. v. Davis, 803 F.3d 904, 907 (7th Cir. 2015) ("An insurance policy on a person's life generally is void if the person did not consent to the issuance of the policy."). Mailed notice. (yxp, ) |
