September 14, 2022 Opinion or Order Filing 11 ORDER; Plaintiff has filed a motion seeking to dismiss this case "immediately." #10 The Court interprets this filing as a notice of voluntary dismissal. Fed. R. Civ. P. 41(a)(1)(A)(i) allows a plaintiff to dismiss an action without a court order by filing "a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment." The effect of such a notice is a dismissal without prejudice effective upon filing. See Smith v. Potter, 513 F.3d 781, 78283 (7th Cir. 2008); Fed. R. Civ. P. 41(a)(1)(B). July 21, 2022 Opinion or Order Filing 7 ORDER : Plaintiff's application for leave to proceed in forma pauperis #3 is denied without prejudice as incomplete. Plaintiff is directed to either (1) submit a renewed application that is certified by a trust fund officer and that includes a copy of Plaintiff's prison trust fund statement showing activity in her account for the six months immediately preceding the filing of her complaint; or (2) pay the full statutory filing fee of $402.00. Failure to comply with this order by August 26, 2022, will result in summary dismissal of this case. The Clerk of Court is directed to send Plaintiff a blank application to proceed in forma pauperis (prisoner version) and a copy of this order. The Clerk also is directed to send a copy of this order to the trust fund office at Pontiac Correctional Center. The Court requests that the office assist Plaintiff in completing the in forma pauperis application, consistent with the rules of the facility. Plaintiff's motion for attorney representation #4 is denied without prejudice. July 14, 2022 Opinion or Order TEXT ORDER entered by Judge Michael M. Mihm on 7/14/2022. Plaintiff filed a Complaint #1 against the Illinois Department of Corrections and prison officials at Dixon Correctional Center ("Dixon") related to an alleged rape by another inmate at Dixon. Venue for federal civil rights actions is governed by 28 U.S.C. 1391(b). According to that statute, such actions may be brought only in (1) the judicial district where any defendant resides (if all defendants reside in the same State), (2) a judicial district in which a substantial part of the events or omissions giving rise to the claim occurred, or (3) a judicial district in which any defendant may be found, if there is no district in which the action may otherwise be brought. It appears that a substantial part of the events or omissions giving rise to the claims in this lawsuit occurred at Dixon located in Lee County, Illinois, which is situated in the federal judicial district of the Northern District of Illinois Western Division. See 28 U.S.C. 93(a)(2). The Court therefore finds that venue over this proceeding is in the Northern District, and that it is in the interests of justice that this cause be transferred there. See 28 U.S.C. 1404(a). No summons shall issue in this action unless directed by the transferee court. The Clerk is directed to transfer this case to the U.S. District Court for the Northern District of Illinois. The Court also notes that Plaintiff, who identifies as female, filed a Motion for Temporary Restraining Order #5 requesting, among other things, to be transferred out of Pontiac Correctional Center to a female prison.
