Filing 6 ORDER: Plaintiff, Richard Wigginton, pro se brings this action against defendants, City of Belvidere, County of Boone, the State of Illinois and its Attorney General, the Boone County States Attorney, two Boone County assistant states attorneys, and a state associate circuit court judge. Plaintiff seeks to enjoin his prosecution in the state court under certain state statutes. He contends that his prosecution under these statutes violates the United States Constitution and federal law. Plaintiff has applied to proceed in forma pauperis ("IFP") #4 . Plaintiff's IFP application discloses he owns a home which was appraised in June 2022 at a value of $267,000 and has an outstanding mortgage balance of $150,000. Based on this information, plaintiff has equity in his home in excess of $100,000. Based on the substantial equity that appears to exist in plaintiff's real estate, the court finds plaintiff has not shown that he is unable to pay the filing fee or give security therefor. 28 U.S.C. 1915(a)(1). Therefore, plaintiff's application to proceed IFP is denied. Plaintiff shall pay the filing fee of $402 within 30 days of the entry of this order or this case will be dismissed.1 Plaintiff's motion for attorney representation #5 is held in abeyance pending payment of the filing fee.
