ORDER, Petitioner's 28 U.S.C. 2241 petition for habeas corpus relief #1 is dismissed without prejudice to him submitting an amended petition that better identifies his claim or to him submitting a motion in the court that sentenced him. It is unclear whether Petitioner requests this Court to reduce his sentence because of changes to the penalty range for his conviction of sex trafficking of a juvenile or to require the Bureau of Prisons to recalculate his sentence because of credits he earned, or programs he participated in, while incarcerated. Petitioner's failure to comply with this order by December 14, 2022, will result in summary dismissal of this case. The Clerk of this Court shall forward an amended 2241 form petition to Petitioner. Petitioner's trust account statement included with his application, though, shows an ability to pay the $5.00 filing fee.1 And so the Court denies his application for leave to proceed in forma pauperis #4 . He must pay the filing fee to proceed with his petition, which he may do by check or money order made payable to Clerk, United States District Court, Northern District of Illinois. ORDER, Petitioner Desmond Manago, a federal prisoner incarcerated at USP Thomson, initiated this 28 U.S.C. 2241 petition seeking relief under the First Step Act: He appears to seek either a modification of his sentence for his 2015 sex-trafficking of a juvenile conviction or recalculation of his sentence by the Bureau of Prisons. Petitioner, though, has neither paid the $5.00 filing fee nor submitted an in forma pauperis application showing an inability to pay. By October 20, 2022, Petitioner must either pay the filing fee with a check or money order made payable to: Clerk, United States District Court, Northern District of Illinois, or submit an in forma pauperis application with his prison trust account statements showing all activity therein for the six-month period before he filed his 2241 petition. Petitioner's failure to comply with this order will result in dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f).
