December 29, 2022 Filing 12 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. If counsel has any questions regarding this process, this #LINK# will provide additional information. Signed by the Executive Committee on 12/29/2022: Mailed notice. (tg, )
December 9, 2022 SUMMONS Issued as to Defendants J-Hulick Electric I, Inc., Christopher Stewart, Stewart Electric LLC. (jp, )

Jensen: The parties shall jointly complete the PDF fillable initial status report form found on Judge Jensen's webpage at www.ilnd.uscourts.gov under Initial Status Conferences and Reports and file by 2/1/2023. November 30, 2022 Filing 10 MINUTE entry before the Honorable Iain D. Johnston: Supplemental jurisdictional statement #9 received and reviewed. The case shall proceed for now. However, the Court will reevaluate the issue of diversity jurisdiction after reviewing the defendants' answers. (yxp, )
November 29, 2022 Filing 9 SUPPLEMENTAL JURISDICTIONAL STATEMENT by SolAmerica Energy Services, LLC (Attachments: #1 Exhibit A - ILSOS J-Hulick Electric I, Inc., #2 Exhibit B - ILSOS Stewart Electric LLC, #3 Exhibit C - Purchase Agreement)(Gistenson, Gregory)
November 21, 2022 Filing 8 MINUTE entry before the Honorable Iain D. Johnston: The plaintiff's amended jurisdictional statement #7 was received and reviewed. Allegations of the citizenship of the LLCs are still inadequate. For the plaintiff LLC, the plaintiff alleges who owns SolAmerica Energy Services, LLC and Osaka Gas SolAmerica, LLC, but does not identify the member(s) of each. For defendant Stewart Electric LLC, the plaintiff does not allege its members, but rather states that its members "are the same as J-Hulick's ownership" (without identifying the ownership of J-Hulick) and that the unidentified members are citizens of Illinois. To adequately allege the citizenship of an LLC, the plaintiff must identify each member and each member's citizenship. The Court again refers the plaintiff to Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2008) ("Consequently, an LLC's jurisdictional statement must identify the citizenship of each of its members as of the date the complaint or notice of removal was filed, and, if those members have members, the citizenship of those members as well."), as well as its own article "Know the answer to federal jurisdiction," which is available on this Court's webpage. A supplemental jurisdictional statement shall be filed by 11/29/2022. (yxp, )
November 18, 2022 Filing 7 JURISDICTIONAL STATEMENT by SolAmerica Energy Services, LLC (Gistenson, Gregory)
November 14, 2022 Filing 6 MINUTE entry before the Honorable Iain D. Johnston: The plaintiff alleges claims under the court's diversity jurisdiction, but does not adequately identify the parties' citizenship. Specifically, for the parties that are LLCs, it does not identify the members, but rather alleges that all members are either not citizens of Illinois (the plaintiff LLC) or are citizens of Illinois (the defendant LLCs). By 11/22/2022 the plaintiff shall file a jurisdictional statement that identifies each member of each LLC, and the citizenship of each member. If a member is itself an LLC, the plaintiff must continue to drill down identifying the members and citizenship of each LLC. See Thomas v. Guardsmark, LLC, 487 F.3d 531, 534 (7th Cir. 2008) ("Consequently, an LLC's jurisdictional statement must identify the citizenship of each of its members as of the date the complaint or notice of removal was filed, and, if those members have members, the citizenship of those members as well."). (yxp, )
