January 10, 2023 Opinion or Order Filing 7 ORDER; The docket reflects an overpayment of $1.00 of the filing fee associated with this action. [See 12/30/22 docket entry showing payment of $403 filing fee.] Accordingly, the Clerk is instructed to: (1) refund the $1.00 overpayment to Plaintiff; and (2) send a copy of this order to the trust fund office at Sheridan Correctional Center. Plaintiff's December 12, 2022 response #6 to the Court's November 30, 2022 show cause order is taken under advisement. The Court will give Plaintiff one more opportunity, until February 17, 2023, to specifically address the concerns identified in the Court's November 30, 2022 show cause order. If Plaintiff fails to respond by the date set forth above, or provides an inadequate explanation to the show cause order, the Court will dismiss this case. The Clerk is instructed to send Plaintiff a copy of this order, along with a copy of the Court's November 30, 2022 show cause order #5 . November 30, 2022 Opinion or Order Filing 5 ORDER; Plaintiff's application for leave to proceed in forma pauperis #4 is denied for lack of a sufficient showing of indigence. By January 3, 2023, Plaintiff must: (1) pay the full statutory filing fee of $402.00; and (2) show cause why this case should not be dismissed for inaccurate representations concerning his finances. If he fails to comply with both of these directives by the aforementioned date, the Court will summarily dismiss this case. Plaintiff is advised that he has a continuing obligation to keep the Court apprised of his current address, and failure to do so will result in dismissal of this action for failure to comply with a court order and for want of prosecution. The Court defers its review of Plaintiff's complaint #1 and his motion for attorney representation #3 until Plaintiff resolves his fee status. See the attached order for details.
