Filing 10 MINUTE entry before the Honorable Iain D. Johnston: On 1/3/2023 the Court issued a rule to show cause why this case should not be dismissed for lack of jurisdiction under 42 U.S.C. 405(g), (h). Dkt. 7. The response was originally due 1/24/2023 and the Court warned that failure to respond may result in dismissal for failure to prosecute under Fed. R. Civ. P. 41(b). Id. The Court then granted Mr. Hicks' motion for an extension of time and reset the deadline to 2/16/2023, see Dkt. 9, but as of the issuance of this minute entry, Mr. Hicks has not responded to the rule to show cause. Accordingly, this case is dismissed for failure to prosecute under Fed. R. Civ. P. 41(b). The pending motions to proceed in forma pauperis #3 and for counsel #4 are stricken. The Clerk is directed to enter judgment and terminate this civil case. (yxp, ) |
