ORDER : This Court has received the $5.00 filing fee for Petitioner Austin Carr's 28 U.S.C. 2241 petition. However, as explained below, the petition may not proceed forward at this time. By March 17, 2023, Carr must respond in writing to this order and show cause why this case should not be dismissed for failing to satisfy the requirements of 28 U.S.C. 2255(e) to bring a 2241 habeas corpus petition. ORDER Petitioner Austin Carr, a federal prisoner confined at USP Thomson, has filed a 28 U.S.C. 2241 petition challenging his 18 U.S.C. 924(c) conviction from the Middle District of Pennsylvania. Carr, however, has neither paid the $5.00 filing fee nor submitted an in forma pauperis (IFP) application demonstrating his inability to pay. The Court notes his two letters stating that he requested Thomson authorities to submit the filing fee payment, that payments from the prison have been delayed, and that his payment may arrive as late as January 8, 2023. See Dkt. Entries 3 and 4. As of the date below, however, the Court has still not received payment. The Court cannot conduct its initial review of Carr's petition to determine if this case can proceed forward until the filing fee requirement has been resolved, either with a check or money order made payable to Clerk, United States District Court, Northern District of Illinois or with a completed IFP application showing his inability to pay. Carr's failure to satisfy the filing fee requirement by February 17, 2023, will result in dismissal of this case without prejudice. See N.D. Ill. Local Rule 3.3(f). Signed by the Honorable Iain D.
