Filing 6 ORDER; The Court has received Plaintiff's motion to dismiss this case #5 , which it interprets as a notice of voluntary dismissal. Fed. R. Civ. P. 41(a)(1)(A)(i) allows a plaintiff to dismiss an action without a court order by filing "a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment." The effect of such a notice is a dismissal without prejudice effective upon filing. See Smith v. Potter, 513 F.3d 781, 78283 (7th Cir. 2008); Fed. R. Civ. P. 41(a)(1)(B). Accordingly, this case is dismissed without prejudice. The Clerk is directed to terminate all pending motions, close this case, and send Plaintiff a copy of this order. Civil case terminated.
