ORDER, On February 17, 2023, this Court requested that Respondent provide a report as to the status of Petitioner Marvin Baker's $5.00 filing fee. #5 A trust fund officer from Petitioner's facility in Terre Haute, Indiana responded to the Court's order indicating that the $5.00 payment was returned to Petitioner's prison trust fund account for "unknown reasons." #6 Upon further investigation into this matter, it appears Petitioner's payment was returned because his check did not include his case number or any other means of referencing the check. To proceed with his case, Petitioner must submit a check or money order made payable to: Clerk, United States District Court, Northern District of Illinois. He should mail his check to U.S. District Court, 327 South Church Street, Rockford, Illinois 61101, and ensure his case number is written on the check. Petitioner's failure to comply with this order by April 17, 2023, may result in dismissal of this case without prejudice. Petitioner's motion #7 requesting the Court order his facility to allow access to his prison trust fund account is denied without prejudice at this time. The Court appreciates the parties' anticipated cooperation in facilitating payment of the filing fee, and further reminds Petitioner that he must follow all applicable rules and procedures necessary to complete his payment request. ORDER : On January 24, 2023, this Court entered an order #3 instructing Petitioner that, to proceed with his case, he must either pay the $5.00 filing fee or file a petition for leave to file in forma pauperis. Petitioner has since submitted a letter #4 indicating that he requested the $5.00 fee be withdrawn from his prison trust fund account, and that his trust statement shows this payment has been deducted from his account. The filing fee, however, has not yet been received by the Court. Respondent is therefore requested to provide the Court with a report as to the status of Petitioner's payment by March 17, 2023. Additionally, the Court notes that the Bureau of Prisons' inmate locator webpage shows that Petitioner is now incarcerated in a federal prison in Indiana. Petitioner is reminded that it is his responsibility to maintain a current address with the Court at all times. The Clerk is instructed to update the docket to reflect Petitioner's current address: USP Terre Haute, P.O. Box 33, Terre Haute, Indiana 47808. The Clerk shall also send a copy of this order to: (1) the Assistant United States Attorney in Charge, United States Attorney's Office, Northern District of Illinois, Western Division; (2) Tom Walsh, Chief, Civil Division, United States Attorney's Office, Northern District of Illinois; (3) the Warden of Petitioner's former facility, USP Thomson; and (4) the Warden of Petitioner's current facility, USP Terre Haute.
