Filing 10 ORDER, Plaintiff may proceed on his amended complaint #8 consistent with this order. The Clerk of Court is directed to: (1) file Plaintiff's complaint #8 ; (2) issue summonses for service on Defendants Castanedo, Rodriguez, and Warden Williams; (3) forward Plaintiff's completed USM-285 service forms 9 to the U.S. Marshals Service; and (4) send Plaintiff a copy of this order. The Court appoints the U.S. Marshal to serve Defendants. The court directs the Marshal to make all reasonable efforts to serve Defendants and authorizes the Marshal to send a request for waiver of service consistent with Federal Rule of Civil Procedure 4(d) before attempting personal service. Plaintiff must promptly update his address if it changes while this case is pending. If he fails to do so, this case will be subject to dismissal with no further warning. Filing 7 ORDER, The Court grants Plaintiff leave to proceed in forma pauperis #3 and service at government expense #5 . The court orders the trust fund officer at Plaintiff's place of incarceration to deduct $24.94 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. Plaintiff's trust fund officer must collect 20% of all income into his trust account until accrued filing fees are paid. Summonses, however, shall not issue at this time as the Court dismisses Plaintiff's complaint #1 for failure to state a claim. Plaintiff is granted until April 18, 2023, to submit an amended complaint and a completed USM-285 (Marshals service) form for each Defendant named in the amended complaint. If he fails to comply, the Court will dismiss this case for failure to state a claim. The Court defers ruling on Plaintiff's motion for attorney representation #4 . The Clerk is directed to: (1) send a copy of this order (electronically if possible) to Plaintiff's trust fund officer; and (2) send Plaintiff a blank amended civil rights complaint form and instructions, a blank USM-285 form, and a copy of this order.
