Filing 17 MOTION by Plaintiff Fredrick D. Thomas for attorney representation (Attachments: #1 Envelope)(pg, ) |
Filing 16 ORDER: The court has reviewed plaintiff's complaint (attached to #1 ("Notice of Removal")) under 28 U.S.C. 1915A. The complaint cannot proceed as drafted and is dismissed without prejudice. Plaintiff is given until July 17, 2023, to submit an amended pleading in accordance with this order. Plaintiff's failure to do so will result in dismissal of this action. The Clerk is instructed to send plaintiff an amended complaint form, along with a copy of this order. Plaintiff's motion for "leave to appear as Zoom/In Person" #10 and motion "to serve subpoena duces tecum to Swedish American Hospital" #15 are denied as premature. Plaintiff may renew his motions once he has submitted an acceptable amended complaint and discovery is proceeding. The motions to dismiss and to stay filed by various defendants [7, 8, 9, 11] are stricken and terminated as moot in light of dismissal of the complaint. Defendants may re-file these motions at a later date if appropriate. Plaintiff also is advised that he must promptly submit a change-of-address notification if he is transferred to another facility or released. If plaintiff fails to keep the court informed of his address, this action will be subject to dismissal for failure to comply with a court order and for failure to prosecute. [See STATEMENT] Signed by the Honorable Philip G. Reinhard on 6/9/2023. Mailed notice. (rsj) |
