MAILED Copy of order #6, amended complaint form and USM-285 form to Plaintiff. (yxp, ) |
Filing 6 ORDER Plaintiff's application for leave to proceed in forma pauperis #5 is granted. The trust fund officer at Plaintiff's place of incarceration is authorized to deduct $23.40 from Plaintiff's account as the initial partial payment of the filing fee and to continue making deductions in accordance with this order as set forth below. The Court directs the Clerk to: (1) send a copy of this order of the facility having custody of Plaintiff (electronically if possible) and to the Court's Fiscal Department. However, summonses shall not issue at this time. Plaintiff's complaint #1 is dismissed without prejudice. If Plaintiff wishes to pursue this litigation, by July 10, 2023, Plaintiff must submit: (1) an amended complaint; consistent with this Order and (2) a separate completed USM-285 service form for each Defendant named in the amended complaint. In addition, by this same date Plaintiff must show cause (explain in writing) why any amended complaint should not be dismissed without prejudice as barred by Heck v. Humphrey, 512 U.S. 477 (1994). Failure to fully comply with this Order by the above date will result in the matter being dismissed without prejudice. The Clerk is directed to send a copy of this order to Plaintiff, along with an amended civil rights complaint form, and a blank USM-285 (Marshals Service) form. The Court advises Plaintiff that Defendants cannot be served without separate completed service forms. See the attached Order for details. Signed by the Honorable Iain D.
