Filing 10 MINUTE entry before the Honorable Iain D. Johnston: Before the Court is the plaintiff's motion for assignment of counsel. Dkt. #9 . In it, she contends she has looked for an attorney to represent her for free, but has been unable to find one. She also states that she is a high school graduate. A Court's exercise of its discretion to assign or deny counsel is governed by the factors set out in Pruitt v. Mote, 503 F.3d 647 (7th Cir. 2007). In light of those factors, and in an exercise of its discretion, the Court denies the motion for counsel #9 . Ms. Wigginton has completed high school, and her filings demonstrate she is able to read and write, to recount the events underlying her complaint, and to set out her claims. She has thus far not identified any circumstances that would make proceeding pro se any more challenging for her than for any other non-attorney proceeding pro se. Moreover, as the Court is now allowed to consider the meritorious nature of the claims, the Court views that factor against assigning counsel to her case. The Court views the fact that an attorney will not represent her as evidence that the market has spokenand spoken in an economically rational way. (yxp, ) |
