The Court finds that jurisdictional discovery is warranted in this case and grants the motion. See e.g. Dancel v. Groupon, Inc., 940 F.3d 381, 386 n. (7th Cir. 2019) ("[W]here issues arise as to jurisdiction or venue, discovery is available to ascertain the facts bearing on such issues." (quoting Oppenheimer Fund, Inc. v. Sanders, 437 U.S. 340, 351 n.13 (1978)). Plaintiff may proceed to execute proposed subpoenas to Estonce, Inc. [8-2], Ricardo Ponce [8-3], and Woot.com LLC [8-4]. June 30, 2023 Filing 5 MINUTE entry before the Honorable Iain D. Johnston: The plaintiff has filed suit against only Doe defendants. It alleges they are "likely" citizens of California, and therefore diverse because it is an Illinois citizen. "John Doe defendants are ordinarily forbidden in federal diversity suits." Pain Center of SE Indiana LLC v. Origin Health Solutions LLC, 893 F.3d 454, 458 (7th Cir. 2018). An exception is made for "nominal partiesnothing more than placeholders," whose citizenship is disregarded for purposes of diversity jurisdiction if complete diversity otherwise exists. Id. at 459. But if the Court disregards the Doe defendants here, no defendant is left and complete diversity is not otherwise established. The Court issues a rule to show cause why this case should not be dismissed for lack of diversity jurisdiction. The plaintiff shall respond by 7/28/2023. Its response should also address if and where it would prefer the case be transferred rather than dismissed. Alternatively, by that date the plaintiff may voluntarily dismiss without prejudice to refiling in state court. (yxp, )
