Date Filed Document Text
August 28, 2023 Filing 13 CERTIFICATE of Service Motion to dismiss by Matthew David Flores on behalf of City of Rockford, Illinois (Flores, Matthew)
August 22, 2023 Filing 12 MINUTE entry before the Honorable Margaret J. Schneider: Plaintiff's motions for copies and for extension of time to respond to Defendants' motion to dismiss #10 #11 are granted. Plaintiff submitted a notice of change of address #7 , thus, it's possible that Defendants sent a copy of their motion and supporting materials to Plaintiff's former address. Nevertheless, Defendants are directed to send Plaintiff a copy of those materials by 08/29/23. Plaintiff is reminded that he has been afforded two options: (1) provide a response to Defendants' motion to dismiss; or (2) submit an amended complaint that also addresses the alleged deficiencies set forth in Defendants' motion to dismiss. The deadline to do so is extended to 09/25/23. Should Plaintiff choose to respond to Defendants' motion to dismiss, Defendants may reply by 10/02/23. Plaintiff is again warned that failure to adhere to this order by the above date may result in a recommendation of summary dismissal of this case for failure to comply with the Court's order. Mailed notice. (jxk)
August 22, 2023 MAILED Copy of Order dated 08/22/2023 to Plaintiff. (jxk)
August 21, 2023 Filing 11 MOTION by Plaintiff Willie James Booker for extension of time to file response (Attachments: #1 Envelope)(pg, )
August 21, 2023 Filing 10 MOTION by Plaintiff Willie James Booker For Copies (Attachments: #1 Envelope)(pg, )
August 7, 2023 Filing 9 MINUTE entry before the Honorable Margaret J. Schneider: Plaintiff's motion for leave to file an amended complaint #8 is denied without prejudice. The Court observes that Plaintiff's amended complaint was signed 07/11/23, and received by the Court on 07/31/23. It appears his amended complaint crossed in the mail with Defendants' motion to dismiss Plaintiff's original complaint for failure to state a claim #5 . As such, Plaintiff's amended complaint does not take into consideration Defendants arguments in their motion to dismiss. For example, Plaintiff's amended complaint does not address whether his claims are barred because of Heck v. Humphrey, 512 U.S. 477, 486-87 (1994) and his convictions in Winnebago County case no. 2001 CF 2346; or whether this lawsuit is barred by the doctrine of res judicata. See Allen v. McCurry, 449 U.S. 90, 94 (1980). These issues are likely to affect any amended complaint Plaintiff may submit. Accordingly, Plaintiff is afforded two options: (1) provide a response to Defendants' motion to dismiss; or (2) submit an amended complaint that also addresses the alleged deficiencies set forth in Defendants' motion to dismiss. The deadline to do so is 09/05/23. Should Plaintiff so choose to respond to Defendants' motion to dismiss, Defendants must reply by 09/19/23. Plaintiff is forewarned that failure to adhere with this order by the above date may result in a recommendation of summary dismissal of this case for failure to comply with the Court's order. Mailed notice. (jxk)
