Filing 9 MINUTE entry before the Honorable Margaret J. Schneider: Plaintiff's motion for leave to file an amended complaint #8 is denied without prejudice. The Court observes that Plaintiff's amended complaint was signed 07/11/23, and received by the Court on 07/31/23. It appears his amended complaint crossed in the mail with Defendants' motion to dismiss Plaintiff's original complaint for failure to state a claim #5 . As such, Plaintiff's amended complaint does not take into consideration Defendants arguments in their motion to dismiss. For example, Plaintiff's amended complaint does not address whether his claims are barred because of Heck v. Humphrey, 512 U.S. 477, 486-87 (1994) and his convictions in Winnebago County case no. 2001 CF 2346; or whether this lawsuit is barred by the doctrine of res judicata. See Allen v. McCurry, 449 U.S. 90, 94 (1980). These issues are likely to affect any amended complaint Plaintiff may submit. Accordingly, Plaintiff is afforded two options: (1) provide a response to Defendants' motion to dismiss; or (2) submit an amended complaint that also addresses the alleged deficiencies set forth in Defendants' motion to dismiss. The deadline to do so is 09/05/23. Should Plaintiff so choose to respond to Defendants' motion to dismiss, Defendants must reply by 09/19/23. Plaintiff is forewarned that failure to adhere with this order by the above date may result in a recommendation of summary dismissal of this case for failure to comply with the Court's order.
