Filing 8 ORDER The Court denies Plaintiff's "mandamus petition" #7 because a writ of mandamus is not appropriate under the circumstances presented by Plaintiff. See Cheney v. U.S. Dist. Court for Dist. of Columbia, 542 U.S. 367, 380-381 (2004); Lindner v. Union Pacific R. Co., 762 F.3d 568, 572 (7th Cir. 2014). Setting aside the procedural defects in Plaintiff's request, the issue presented by the petitioni.e., Plaintiff's wish for this Court to order the Superintendent of the Winnebago County Jail to release his wallet and debit card to a third partyis frivolous. Plaintiff's ability to obtain money from his bank account to pay the filing fee in this case is a matter between him and his bank, with more than just one way to resolve the issue. Payment of the $402.00 filing fee remains due on September 25, 2023. He may pay by cashier's check or money order payable to Clerk, United States District Court. He should mail payment to Clerk, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk. Failure to remit the fee by the above date will result in summary dismissal of this case.
