ORDER : Petitioner Keith Hoddenbach has filed a pro se 28 U.S.C. 2254 petition challenging his 1986 Cook County convictions for murder, attempted murder, and aggravated battery.1 As his petition acknowledges, he has not paid the $5.00 filing fee. See Dkt. Entry 1, pg. 17 (he explains that he e-filed the petition but cannot e-file payment). By November 6, 2023, Petitioner must either: (1) pay the $5.00 fee with a check or money order made payable to Clerk, United States District Court for the Northern District of Illinois that includes the case number of this case; or (2) submit a completed in forma pauperis (IFP) application with a copy of his prison trust account statement demonstrating his inability to pay the fee. Failure to comply with this order will result in summary dismissal of this case without prejudice. His motion for the appointment of counsel #3 is denied without prejudice. While appointment of counsel is warranted for evidentiary hearings or when the interest of justice so requires, such a determination usually cannot be made until after Respondent responds to the petition. See Rule 8(c) of the Rules Governing 28 U.S.C. 2254 Cases (citing 18 U.S.C. 3006A(a)(2)); Cotto v. Lashbrook, No. 17 C 3719, 2017 WL 11537966, at *1 (N.D. Ill. June 2, 2017).
