Filing 5 ORDER : Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $31.01 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at the facility having custody of Plaintiff and to the court's fiscal department. Summonses, however, shall not issue. Plaintiff's complaint #1 is dismissed without prejudice for failure to state a claim. If Plaintiff wants to proceed with this lawsuit, she must submit an amended complaint that states a federal claim. Failure to submit an amended complaint by January 31, 2024, will result in dismissal of this lawsuit for failure to state a claim. Plaintiff also is advised that she must promptly submit a change-of-address notification if she is transferred to another facility or released. If Plaintiff fails to keep the Court informed of her address, this action will be subject to dismissal for failure to comply with a Court order and for failure to prosecute. Plaintiff's motion for attorney representation #4 is denied without prejudice. [See STATEMENT] Signed by the Honorable Iain D. Johnston on 1/3/2024. Mailed notice (jp, ) |
