January 8, 2024 Opinion or Order Filing 7 ORDER: Petitioner was ordered to pay the five-dollar filing fee by December 22, 2023. (Dkt. 5.) He was warned that failure to pay the fee would result in dismissal of this case. Id. Petitioner has not paid the fee or otherwise asked for an extension of time to pay. This case is dismissed without prejudice for failure to pay the filing fee. Petitioner remains liable for the fee in this case and must pay the fee if he wishes to refile his case in a future habeas corpus action. This dismissal is without prejudice and does not count as a first petition for purposes of the prohibition on unauthorized second or successive habeas corpus petitions. Altman v. Benik, 337 F.3d 764, 766 (7th Cir. 2003) (per curiam) (citing Benton v. Washington, 106 F.3d 162, 165 (7th Cir. 1996)). Any pending motions are moot. Civil case terminated.
