Filing 4 MINUTE entry before the Honorable Iain D. Johnston: Before the Court is a complaint filed by "Laura Epstein, for herself and as next friend of her minor child 'ME.'" She appears to be suing in two separate capacities---individually, and as the next friend of her child. Ms. Epstein also filed a single pro se appearance, which again appears to be filed in two separate capacities---individually and as the next friend of her child. Under Winkelman ex re. Winkelman v. Parma City School Dist., 550 U.S. 516 (2007), she may proceed under the Individuals with Disabilities Education Act in her own capacity as the parent of a child challenging the adequacy of an IEP. However, Winkelman explicitly did not reach the issue of whether parents may also litigate such claims pro se in the capacity of their child's next friend, an issue the Supreme Court found unnecessary to reach given that parents can sue in their own capacity. By 3/13/2024 Ms. Epstein shall file a position paper addressing the following issues: (1) clarifying whether she is suing only in her own capacity, or whether she is also suing separately in the capacity as her minor child's next friend; and (2) if she is also suing as her child's next friend, authority allowing her to do so pro se, as she has indicated she is doing on her appearance form.
