ORDER, The habeas corpus petition #1 is dismissed without prejudice. Petitioner's motion for leave to proceed in forma pauperis, #2 along with any pending motions, are denied as moot. Petitioner is advised that: (1) the Court is not deciding the merits of his claim; (2) to pursue his claim, he should refile it immediately in a separate civil rights action subject to the normal rules prohibiting frivolous lawsuits; and (3) a civil rights action is governed by the requirements of the Prison Litigation Reform Act (PLRA).
