Johnston: The plaintiff has sued the Illinois State Board of Education asking this Court to enjoin it from "continuing to enforce Diversity, Equity, and Inclusion (DEI) programs." Compl. at 6. The only standing she asserts is as "a taxpayer residing in the Northern District of Illinois." Id. As the U.S. Supreme Court explained in Hein v. Freedom from Religion Foundation, Inc., 551 U.S. 587, 593 (2007), taxpayers lack Article III standing except in a narrow class of cases alleging that a specific congressional appropriation has led to a violation of the U.S. Constitution. The complaint alleges the opposite, that the Illinois State Board of Education vows to continue enforcing DEI programs even at the risk of losing federal funding.
