January 13, 2026 Filing 18 MINUTE entry before the Honorable Iain D. Johnston: Muhammad's amended application to proceed in forma pauperis #9 is granted. His motion for a preliminary injunction #10 is denied without prejudice. The Court is required to dismiss a case filed in forma pauperis if it determines the action fails to state a claim on which relief may be granted. 28 U.S.C. 1915(e)(2)(B)(ii). As described by the Court at dkt. 8, charges for trespassing being dismissed does not equate to a trespass ban being unconstitutional or unenforceable. Plaintiff's exhibits attached to his motion for an injunction demonstrate he has twice been permanently banned from the Rockford Housing Authority: once on August 11, 2023 under the name Bobby F. Brookins, for "Illegal live-in / Narcotics / Violent Offender" and again on August 19, 2025 under the name Amir Abdullah Saladin Muhammad for "Non-Resident / Illegal live-in / Previously banned under birth name Bobby Brookins." In the State of Illinois, criminal trespass to real property is defined in part as when a person "enters upon the land of another, after receiving, prior to the entry, notice from the owner or occupant that the entry is forbidden." 720 ILCS 5/21-3(a)(2). Despite having this notice, Muhammad has provided no support for why as a matter of law he still maintains a right to enter the property. Moreover, he provides no support for Rockford Housing Authority's trespass ban being unconstitutional; rather, he has asserted only that it has not resulted in a conviction. Finally, the complaint still falls well short of the requirements of City of Los Angeles vs. Lyons, 461 U.S. 95 (1983). Muhammad is provided until 01/30/2026 to file an amended complaint which states a claim upon which relief may be granted or the civil case will terminate. December 23, 2025 Filing 8 MINUTE entry before the Honorable Iain D. Johnston: Plaintiff's motion to proceed in forma pauperis #3 is denied without prejudice. The application submitted is incomplete in multiple areas. Plaintiff's motion for a Temporary Restraining Order #4 is denied without prejudice. Ex parte TROs should be granted only under "extremely limited" circumstances. American Can Co. v. Mansukhani, 742 F.2d 314, 321 (7th Cir. 1984). The standards for a Temporary Restraining Order however are the same as that for a Preliminary Injunction. Gray v. Orr, 4 F.Supp. 3d 984, 989 n. 2 (N.D. Ill. 2013). So, the Court must consider whether Plaintiff (1) will suffer irreparable harm before the final resolution, (2) available remedies at law are inadequate, and (3) he has a likelihood of success on the merits. Knox v. Shearing, 637 F. App'x. 226, 228 (7th Cir. 2016). A motion for a TRO must also comply with Fed. R. Civ. P. 65(b). On the face of the complaint and motion, Muhammad has, at minimum, failed to demonstrate likelihood of success on the merits. He merely states that he was twice trespassed and charged, but that the offenses were dismissed. Charges being dismissed does not equate to a trespass ban being unconstitutional. In fact, he has provided nothing to support his claim that the threat of continued enforcement is unconstitutional. What's more, Plaintiff's requested injunctive relief runs afoul of City of Los Angeles v. Lyons, 461 U.S. 95 (1983) as there is no evidence or even allegations that he is likely to suffer an injury in the future. Furthermore, Plaintiff has failed to certify any efforts made to give notice and the reasons why it should not be required. Fed. R. Civ. P. 65(b)(1) (B). Prior to submitting an amended motion for a Preliminary Injunction, Plaintiff shall provide Defendants notice, which need not be formal service but shall comply with Fed. R. Civ. P. 65(b). Finally, Plaintiff shall pay the filing fee or submit a completed application to proceed in forma pauperis by January 7, 2026. The completed application should provide information as to Plaintiff's last employer, his spouse's last employer, and details on their contributions towards seven dependents with reportedly no income in the last 12 months.
