August 7, 2009 Opinion or Order Filing 49 ORDER: As all claims in this action have been dismissed and the case is closed, the Court now DIRECTS the Clerk of the Court to enter judgment in favor of Defendants Kabat and Shirley and against Plaintiff Ford as to Count 1. March 27, 2009 Opinion or Order Filing 41 ORDER DENYING AS MOOT 34 MOTION for Summary Judgment: As fully explained in the attached Order, Claim 2 of Ford's complaint must be severed from this action pursuant to George v. Smith, 507 F.3d 605 (7th Cir. 2007). However, because severance necessitates the opening of a separate action with a new filing fee to be assessed, the Court permits Ford an opportunity to voluntarily dismiss, if he so chooses. The Court hereby DIRECTS Ford to inform this Court whether he wishes to voluntarily dismiss claim two no later than April 20, 2009. If Ford elects not to voluntarily dismiss claim two, or if he fails to submit a timely response to this Order, the Court will sever claim two. Finally, because the only remaining claim will be either voluntarily dismissed or severed into a new action, the motion for summary judgment (Doc. 34) is hereby DENIED AS MOOT, without prejudice and with leave to re-file in the severed action.
