ORDER GRANTING IN PART AND DENYING IN PART 63 MOTION to Dismiss Second Amended Complaint : For the reasons stated in the attached Order, the Court hereby GRANTS IN PART AND DENIES IN PART Defendant's motion to dismiss (Doc. 63). The mo tion is GRANTED to the extent that the Court dismisses Count 1, but Roche is given leave to file an amended complaint clearly stating her breach of contract claim under a third party beneficiary theory.
